1. Acceptance of terms
By accessing or using SimpleSiteWatch, you agree to these Terms of use. If you are using the service on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.
2. Accounts and eligibility
- You must provide accurate account and billing information and keep it reasonably up to date.
- You are responsible for activity that happens through your account unless caused by our breach or systems outside your control.
- You must keep login credentials secure and notify us promptly if you believe your account has been compromised.
3. The service
SimpleSiteWatch is a website monitoring and reporting platform. Features may include watchpoint monitoring, uptime checks, performance and accessibility insights, domain-related monitoring, analytics integrations, reports and billing administration. Specific features, limits and retention periods depend on the plan you purchase.
4. Subscriptions, billing and renewal
- Paid plans are billed in advance on the subscription term shown at checkout.
- Unless stated otherwise, subscriptions renew automatically using your saved payment method.
- You authorise us and our payment provider to charge the recurring fees, taxes and other agreed charges for your plan.
- If payment cannot be collected, we may retry the charge, request an updated payment method, suspend renewal-dependent service access, or cancel the subscription in line with the platform rules.
- Changes to plan limits or pricing for future terms can be notified before they take effect.
5. Customer responsibilities
- You are responsible for the URLs, domains, account data and third-party property details you submit to the service.
- You must have the right to monitor the websites or properties you connect to the platform.
- You are responsible for granting and maintaining the third-party access needed for integrations you choose to use.
6. Third-party services
Some parts of the service rely on third-party providers, such as billing, analytics and search platforms. Your use of those connected services may also be subject to the terms and policies of the relevant provider. We are not responsible for outages, access changes or policy changes imposed by those providers, although we will try to keep the platform aligned with them where reasonably practical.
7. Acceptable use
- You must not use the service in a way that is unlawful, abusive, deceptive or likely to interfere with the operation of the platform.
- You must not attempt to probe, reverse engineer, disrupt or bypass security or subscription limits except to the extent the law cannot restrict that activity.
- You must not use the service to monitor websites or data sources where you do not have authority or a legitimate operational reason.
8. Availability and changes
We aim to keep SimpleSiteWatch available and improve it over time, but we do not promise uninterrupted or error-free operation. Maintenance, third-party outages, scaling events, API limits and other issues can affect availability. We may update, improve, replace or retire features where reasonably necessary.
9. Data, privacy and security
We handle service data in line with our security and privacy approach for the platform. You acknowledge that no internet-based service can be guaranteed completely secure, but we aim to take reasonable steps appropriate to the nature of the information we hold and the service we provide.
10. Intellectual property
We retain all rights in the SimpleSiteWatch service, software, design, branding and related materials, except for content, URLs, account information and other customer data you provide. You receive a limited, non-exclusive, non-transferable right to use the service during your active subscription in line with these terms.
11. Suspension and termination
- You may cancel renewal in line with the options made available in the billing area.
- We may suspend or terminate access if payment remains outstanding, the service is used in breach of these terms, or continued access creates a security, legal or operational risk.
- Where practical, we will usually try to provide notice before suspension or termination, but immediate action may be required in some situations.
12. Liability and consumer rights
Nothing in these terms excludes rights or remedies that cannot be excluded under applicable law, including applicable consumer guarantee rights. To the maximum extent permitted by law, SimpleSiteWatch is provided on an as-is and as-available basis, and our aggregate liability for claims connected with the service will be limited to the amount paid for the relevant subscription period giving rise to the claim or, if lower, the minimum amount required by law.
We are not liable for indirect, consequential or special loss, or for loss of profit, revenue, goodwill, data or opportunity, except to the extent liability cannot lawfully be excluded.
13. General
These terms are governed by the laws applying in the Australian Capital Territory and the Commonwealth of Australia, unless another mandatory law applies. If a clause is unenforceable, the rest of the terms continue in effect. We may update these terms from time to time by publishing an updated version on the site.
